Public offer

For this Offer, a Plan means a set of terms established by the Operator that determines the price, access period, included features, and limits for paid Tendy.by features.

ООО «ДЕФАЙНТ», UNP 291880617, offers the User access to paid Tendy.by features under this Public Offer. This Offer applies together with the Terms of Use (tendy.by/legal/terms), which form an integral part of the contractual relationship between the Operator and the User.

Paid features may include advanced search, unlimited views, templates, team access, AI analysis (available after the User explicitly enables it in the privacy settings), notifications, and other features specified in the Plan.

Payment for a Plan, starting a trial, activation of paid features, or clicking the button confirming agreement with the paid access terms in the Service constitutes acceptance of this Offer.

A person accepting the Offer on behalf of an organization confirms that they are authorized to act on its behalf. Without such authority, that person is personally responsible for obligations under this Offer.

The Plan price is shown on the pricing page, invoice, payment form, or other payment interface. Payments are made in Belarusian rubles unless otherwise stated.

The access period, features, and limits are determined by the selected Plan. If the User enables automatic renewal, payment for the next period is charged automatically no later than the end date of the current period. The Operator sends notice of the upcoming charge at least 3 calendar days in advance to the email address in the User’s Account; notice is deemed sent when dispatched. Failure to send notice does not affect the validity of an automatic charge while automatic renewal is enabled. The User can disable automatic renewal in the account settings before the next period begins. If automatic renewal is disabled, access is extended after the next payment.

Access to paid features is provided after payment or confirmation of the Plan by the Operator. Services are provided remotely through the website and user account.

The Operator may perform maintenance, update, change, or remove individual features, and temporarily restrict access where necessary for security, stability, or Service development. The Operator gives advance notice of planned maintenance through the Service or by email. The Operator may change the Plan’s features by notifying users at least 10 calendar days in advance through the Service or by email; such changes do not affect an access period that has already been paid for.

If paid access was not provided due to the Operator’s fault, or if more than 50% of the Plan features listed on the pricing page at the time of payment were removed during the paid period, the User may contact hello@tendy.by for investigation and resolution, including a proportional refund.

No refund is provided if the User has actually used paid features, voluntarily stopped using the Service before the paid period ended, or had access restricted due to a breach of the Terms of Use.

Claims must be sent to hello@tendy.by within 30 calendar days of discovering the grounds for the claim and are reviewed individually within no more than 30 calendar days of receipt, taking account of actual Service use, Plan terms, and applicable laws of the Republic of Belarus.

The Operator is not responsible for the User’s decisions to participate or not participate in procurement, the results of tenders, or actions of buyers, marketplaces, and third parties. The Operator is also not liable for failure to perform obligations caused by force majeure, including but not limited to natural disasters, military action, acts of public authorities, communication or power network failures, DDoS attacks, and other events beyond the Operator’s reasonable control. In all cases, the Operator’s aggregate liability under this Offer is limited to the amount actually paid by the User in the 12 months preceding the event giving rise to the claim.

The Service does not guarantee complete data, the absence of errors in open sources, success in a procurement procedure, or financial benefit. The Operator is not liable for indirect losses, lost profits, loss of data, business reputation, or expected savings arising from use of, or inability to use, the Service.

For payment, documentation, and Plan access questions, contact hello@tendy.by. The Operator may suspend or terminate paid services for a breach of the Terms of Use and notify the User by email. In the event of a security threat or a serious breach of the Terms, the Operator may suspend access immediately and subsequently notify the User within a reasonable time. This Offer is governed by the laws of the Republic of Belarus. Disputes not resolved through negotiation shall be submitted to the court at the Operator’s location.
