Terms of use
Rules for accessing Tendy.by, service limitations, and user obligations. All documents
1. General provisions
For these Terms, a User means any individual, individual entrepreneur, or legal entity visiting tendy.by or using Tendy.by. These Terms govern use of the tendy.by website, the user account, procurement search, Tendy AI analysis, and related features of Tendy.by (the Service). The Service includes the website, user account, and all search, analysis, and notification features, including Tendy AI.
The Service operator (the Operator) is ООО «ДЕФАЙНТ», UNP 291880617. By using the Service or registering an account, the User confirms that they have read and accept these Terms.
2. What the Service does
Tendy.by helps users find, save, and analyze procurement information published by open official sources and electronic marketplaces. The Service is provided “as is”, without any express or implied warranties, including fitness for a particular purpose. The Operator is not liable for indirect losses, lost profits, loss of data, business reputation, or expected savings arising from use of, or inability to use, the Service. In all cases, the Operator’s aggregate liability under these Terms shall not exceed the amount actually paid by the User in the 12 months preceding the event giving rise to the claim.
The Service may display procurement cards, documents, lots, events, filters, search templates, notifications, AI summaries, and other working tools.
3. Procurement information
Procurement data is collected automatically from open sources. It may be incomplete, inaccurate, or outdated. Before participating in a procurement procedure, the User must independently verify information on the original marketplace and review the documents, buyer requirements, deadlines, and applicable law.
4. Tendy AI
Tendy AI is a Service feature that uses artificial intelligence language models to analyze procurement cards and provide information to users. Tendy AI is not legal, financial, accounting, or other professional advice and does not guarantee success in a procurement procedure. To operate Tendy AI, query text and related context (such as an open procurement card) are sent to language model providers, including providers outside the Republic of Belarus. This processing is described in the Personal Data Processing Policy.
When Tendy AI is used, query text and related context are processed under these Terms. The User can control processing of Tendy AI queries, including cross-border transfers, in the account privacy settings. Processing of Tendy AI queries is disabled by default until the User explicitly enables it.
5. User account
For these Terms, an Account means a user account containing registration data, settings, saved procurements, search templates, and the history of using Tendy.by.
- The User is responsible for the accuracy of information provided during registration.
- The User must keep access to the Account confidential.
- Actions performed through the User’s Account are deemed to have been performed by that User. The User is responsible for all actions performed using their credentials until the Operator receives notice that the account has been compromised, sent to hello@tendy.by or through the feedback form in the Service. Notice is deemed received when the Operator confirms receipt.
- The Operator may restrict access for a breach of these Terms, suspected misuse, or a threat to Service security, and subsequently notify the User of the reasons within a reasonable time.
6. Acceptable use
- Do not attempt to disrupt the Service, bypass limits, scan infrastructure, or gain unauthorized access.
- Do not use the Service for unlawful activities, spam, infringement of third-party rights, or automated resale of data obtained through the Service. The User must not copy, modify, decompile, or create derivative works based on the Service. All intellectual property rights in the Service, including software, interfaces, databases, algorithms, and content created by the Operator, belong to ООО «ДЕФАЙНТ» or its licensors and are protected by the laws of the Republic of Belarus.
- Do not present automated Service conclusions as official information from a marketplace or buyer.
7. Plans and limits
Some features may be available free of charge subject to limits. Extended features may be available under paid plans.
Current plans, limits, and included features are published on the pricing page or in the payment interface.
8. Changes to these Terms
The Operator may update these Terms. A new version takes effect no earlier than 10 calendar days after publication on the website, unless it specifies a later date. These Terms are governed by the laws of the Republic of Belarus. Disputes not resolved through negotiation shall be submitted to the court at the Operator’s location. Continued use of the Service after the changes take effect constitutes the User’s acceptance. A User who disagrees with the changes may stop using the Service and delete their Account before the new version takes effect.
