License agreement for the “Tendy: тендеры и закупки Беларуси” Bitrix24 app
Terms for using the “Tendy: тендеры и закупки Беларуси” app from Bitrix24 Market. All documents
1. Parties and subject
1.1. The Licensor is ООО «ДЕФАЙНТ», UNP 291880617, located at Республика Беларусь, Брестская область, Ленинский район, г. Брест, ул. Интернациональная, дом 17, пом. 9-п (the Licensor).
1.2. The Licensee is a legal entity, individual entrepreneur, or individual who installs “Tendy: тендеры и закупки Беларуси” (the App) on their Bitrix24 portal (the Portal) through Bitrix24 Market.
1.3. The Licensor grants the Licensee a simple, non-exclusive, free-of-charge license to use the App within the Portal under this agreement. Installing the App on the Portal constitutes acceptance of this agreement.
1.4. The App is a client of Tendy.by (the Service) within Bitrix24. Use of the Service is governed by the Terms of Use (https://tendy.by/legal/terms) and Public Offer (https://tendy.by/legal/offer), which apply to matters not covered by this agreement.
2. App features
2.1. In the Portal interface, the App enables users to:
- use Tendy.by, including procurement search, viewing, and applications, after signing in to a Tendy account;
- create CRM deals from procurements, including buyer companies with UNP-based requisites;
- depending on organization settings, add buyer contact persons published in procurement notices to the deal and buyer company;
- synchronize Tendy application statuses and linked deal stages in both directions according to organization settings;
- view a procurement card in the “Tendy” tab of a deal card.
3. Access conditions
3.1. The App is provided free of charge. It requires a Tendy.by account and the Licensee’s organization in the Service on a paid plan, including a paid plan trial. Service plans are published at tendy.by. The App can be installed on a free plan, but its features are unavailable.
3.2. Installation and the first connection between the Portal and a Service organization must be performed by a Portal administrator who is also the organization’s owner or administrator in the Service. Other Portal users sign in with their own Service accounts belonging to the same organization.
3.3. The App requires these Portal permissions: CRM (crm), basic user information (user_brief), and interface embedding (placement). It does not request Bitrix24 usernames or passwords; authorization uses OAuth 2.0.
4. Data
4.1. Following Portal users’ actions and organization settings, the App creates and updates CRM deals, companies, requisites, and addresses, and contacts when “Создавать контакты заказчика” (Create buyer contacts) is enabled. It also creates custom deal fields “Приём предложений до (tendy)”, “Номер закупки (tendy)”, “Тендер в Tendy (tendy)”, and “Тендер на площадке (tendy)”. Procurement and buyer information comes from open sources.
4.3. “Создавать контакты заказчика” (Create buyer contacts) is disabled by default. By enabling it, the Licensee instructs the App to transfer buyer contact information published in procurement notices to the Portal CRM and independently determines the purposes and procedures for further processing in the Portal under personal data law.
4.2. Processing of data received from the Portal is described in the Data Processing Policy for “Tendy: тендеры и закупки Беларуси” (https://tendy.by/legal/bitrix24-privacy) and the Service Personal Data Processing Policy (https://tendy.by/legal/privacy).
5. Liability
5.1. The App is provided “as is”. The Licensor takes reasonable steps to ensure correct operation but does not guarantee uninterrupted operation, including when Bitrix24, the Service, or procurement data sources are unavailable.
5.2. The Licensee independently checks procurement information against original sources (electronic marketplaces) before deciding whether to participate.
5.3. The Licensor’s liability is limited as provided by the Service Terms of Use and the laws of the Republic of Belarus.
6. Uninstalling the App
6.1. The Licensee may uninstall the App from the Portal at any time. On uninstallation, the Licensor stops accessing the Portal and deletes stored Portal access keys; Bitrix24 removes the App tabs.
6.2. Deals, companies, contacts, and requisites created in the Portal CRM remain in the Portal and belong to the Licensee.
7. Support and changes to the terms
7.1. Support: support@tendy.by. Response time: within 2 hours.
7.2. The Licensor may amend this agreement by publishing a new version at tendy.by/legal/bitrix24-license. Continued use of the App after publication constitutes acceptance of the new version.
7.3. The parties’ relationship is governed by the laws of the Republic of Belarus.
